General
A contract is formed with Detail Technologies Ltd
as soon as the order is placed either via our website,
via the telephone or the moment we receive your
faxed order, or cheque, if you order via post.
The
contract is an agreement to all our Terms and Conditions
(below), our Sales
and Return Policy and our Privacy
Policy and it sets the conditions imposed by
Detail Technologies Ltd.
The
contract is made in the English language.
This
contract cannot be transferred or sublicensed.

Cancelling
Your Order
Right

Our
Sales and Returns Policy does not affect your Statutory
Rights. For more information about your Statutory
Rights go to the Department of Trade and Industry's
website at: http://www.dti.gov.uk/consumers/index.html
All
goods can be returned within 7 working days of receiving
them, if they are unsealed, for a full refund.
The
only time we can accept the return of unsealed goods
is if they are faulty.
Any
goods returned to us, under the right to cancel
must be paid for at the customers own cost.
In
order to send your order back to us, under the right
to cancel, you must contact us to inform us, so
that you can be issued with a Detail Returns Number
(DRN). When you send the product back to us you
must clearly mark the Detail Returns Number (DRN)
on the packaging. We cannot accept liability for
any returns sent without a Detail Returns Number
(DRN). If an item is returned to us without a Detail
Returns Number (DRN) then it is at the discretion
of Detail Technologies Ltd as to whether we accept
the returned item or request that the item be returned
back to the sender.

(a)
Computer Software
Computer
Software is classified under the exempted categories
of the Distance
Selling Regulations. Therefore all our Computer
Software products cannot be returned for a refund
if they are unsealed and not faulty, registered,
or if the right to cancel is not made within 7 working
days of you receiving your order.
If
the product has not been unsealed, is unregistered
and if the right to cancel is made within 7 days
of receiving the order then a full refund can be
obtained.
The
software products operate in Trial Mode for 7 days
and they need to be registered within 7 days of
being installed onto your computer, or they will
not be accessible after the 7 days, until they are
registered. Therefore please be advised that once
you unseal and register any of our software products
you are no longer entitled to return them for a
refund.
(b)
DVD and Audio
Audio
and DVD products cannot be returned for a refund
under the right to cancel once they have been received
and unsealed, unless they are faulty.
If
these products have not been unsealed then they
can be returned within 7 working days of receiving
them.

Books
MCQ
Books and Blackstone Manuals can be returned under
the right to cancel within 7 working days of receiving
them.
(d)
Online Services
For
our ONLINE services because the service starts immediately
from when the order is placed these services cannot
be cancelled once they have been activated. For
this reason you are encouraged to use the free 'Trial
Account' prior to purchasing.
Delivery
Costs for Returned Products
Any
goods returned to us, under the right to cancel
that are not damaged, not defective or have not
been sent in error, must be paid for at the customers
own cost.

Returning
Damaged or Defective Products
If
you have received a damaged or defective product
we will provide you with a free post address to
send the product back to us.
You
need to contact us to get a Detail Returns Number
(DRN) before returning a damaged or defective item
and in order to get our free post address.
As
soon as the damaged or defective item is received
by us, we will send you a replacement straight away,
unless we are awaiting stock. If we are awaiting
stock the replacement will be sent as soon as the
stock is received.
No
Detail Returns Number (DRN) will be issued after
the date of the National Examination, for which
the product was purchased, has passed.
Refunds
All
refunds will be made within 30 days of the date
of cancellation, when a DRN is issued, and when
Detail Technologies have received the goods back
and are happy with the condition of the returned
items. Should any items be returned in a condition
that renders them un-saleable then no refund will
be issued.

Delivery
All
Computer Software, Audio and DVD products are dispatched
via first class Royal Mail. All orders received
by 15:00 are generally dispatched the same day.
All orders will be delivered within 3 working days
(excluding Bank Holidays) unless otherwise stated.
Normally you will receive your order the next working
day.
Blackstone
Manuals will be delivered within 5 working days
of the order received date. The reason for this
delivery time is that we only keep limited stock
of this item.
Blackstone Manuals are sent via courier and must
be signed for upon delivery. Because of this if
no-one is at the address to sign for them a card
will be left by our courier asking for you to contact
them to arrange re-delivery. You must arrange re-delivery,
with the courier directly, within 3 days or the
books will be returned to us and we will either
charge you a re-delivery charge of £5 or refund
your order minus the £5 original delivery
charge, that is included in the price of the manuals.
We
are unable to deliver Blackstone Manuals to the
Isle of Wight, the Isle of Man, Northern & the
Republic of Ireland.

Payment
We
allow goods to be paid for via a 0% monthly instalment
payment plan, in order to allow the payment for
the goods to be spread over a period of time (payments
are £25 a month with the final balance of
up to £49.99 collected in the final month
of the plan). Please note if your purchase includes
the Blackstone Police Manuals the initial payment
will be £50 not £25, with the following
payments being £25 a month and the final balance,
of up to £49.99, collected in the final month
of the plan.
If
you pay for your goods in this way Detail Technologies
Ltd will still own any goods you receive until your
final payment for those products or services has
been paid.
Please
ensure if you are paying in this way that the payment
card you use does not expire before the end of your
payment plan. If the card expires before the end
of the plan we will not be able to fulfil your order
until we have received alternative payment card
details from you, that are valid for the length
of the plan.
All
payments required under the monthly instalment payment
plan must be made as set-out on the monthly instalment
payment plan you will receive with your order.

Any late payments will be subject to late payment
charges.
If
we have been unable to take a payment on the payment
due date we will attempt to contact you via telephone.
If we cannot contact you via telephone we will either
leave an answer phone message or we will send you
a letter. We will then give you a 7 day waiting
period in order for us to receive the payment. If
the payment is still not received within the 7 days
after the payment due date the late payment charge
will be issued.
The
late payment charge is £12, this is charged
if the payment is not received on the payment due
date or within the 7 day waiting period thereafter.
Also the late payment charge of £12 will charged
every thirty days until the debt is settled. Failure
at any point to honour your monthly instalment payment
plan will cause Detail Technologies Ltd to recover
the full amount which is owed to us at that juncture.
For example should £114.99 be owing on your
monthly instalment payment plan, if we have been
unable to take the £25.00 payment that is
due, then we will seek to recover the £114.99
plus the late payment charges immediately.
A
debt will be classified as an unrecoverable debt
when the payment has been outstanding for over
30 days, or when we have been unable to take the
monthly instalment payment that was due on the payment
date, on two or more occasions, where the payment
was not received within the 7 day waiting period
given after the payment due date.
Any unrecoverable debts will be liable to be referred
to the officers' Professional Standards Department
within their Police Force, under Regulation 1 (Honesty
and Integrity) & Regulation 12 (General Conduct)
of the Police (Conduct) Regulations 2004, and to
a Debt Collection Agency for collection.

Usage
Our
PASS products may only be used by one user on one
machine at any one time. Failure to comply with
this term may result in criminal proceedings being
taken under copyright and piracy laws.
The
PASS program can be transferred from one machine
onto another, between as many machines as required,
and it can be transferred back and forth however
many times you require.
If
you have a problem with the machine that the PASS
program is registered on resulting in you no longer
being able to access the program to transfer it
onto another machine, such as your hard disc becoming
unusable, this will result in you needing to re-licence
the software on another machine.
You
will also need to re-licence the software should
you buy a new machine, if you can no longer access
the old machine. If you can access the old machine
you can transfer the program from the one machine

Re-Licensing
requires you receiving a new set of unlock codes
for your program. Due to security issues, the only
way these codes can be obtained is if we receive
a hand signed document from you, either by fax or
post, no other form of communication (such as email)
is acceptable. The form that you need to complete
and send to us can be downloaded here

Please
note that during re-registration we will not re-register
an older version of PASS. If you have an older version
of PASS and need to re-register you will be required
to upgrade to the latest version of PASS. If you
have already purchased a PASS Guarantee and have
complied with the terms and conditions of the PASS
Guarantee then this upgrade will be free. If you
have not purchased a PASS Guarantee, or if you have
purchased a PASS Guarantee but it has become invalid
due to you not complying with the Terms and Conditions
of the PASS Guarantee then you will be charged at
our standard upgrade price.
Please
note that these re-registration Terms and Conditions
are not confined to the year edition of PASS as
they relate to the version of the program itself.
Therefore, for example, if PASS 2007 Version 7 (V7)
was released in September 2006 and in December 2006
PASS 2007 Version 8 (V8) was released then PASS
V7 would not be re-registered by Detail Technologies
Ltd. This would require all PASS 2007 V7 customers
to upgrade to PASS 2007 V8.

The
Licence Agreement outlined during the installation
of your software product must be fully complied
with, in addition to our Terms and Conditions. To

The
PASS Technical Support Contract expires the moment
after the examination for which that product was
purchased.
Free Technical Support is given for seven days after
receiving your product (excluding weekends and Bank
Holidays) by telephoning us on 0870 800
2 999.
Any additional Technical Support will be charged
for, and can be obtained by using our premium rate
telephone number on 0905 511 0052.
Please note that this service costs 60p a minute,
unless you have purchased a PASS Guarantee, or unless
you decide to purchase a PASS Guarantee at that
juncture.
A
PASS Guarantee can be purchased for any software
product, either initially when the product is purchased,
or at any time within 1 calendar month after the
product was originally purchased.
With
the PASS Guarantee you are entitled to free Technical
Support for the life span of your PASS Guarantee,
by contacting us on 0870 800 2 999
(please note that calls to this number are charged
at local rate).
If
you contact our main office number of 0870
800 2 999 requesting technical support
after your free seven days, if you have not purchased
a PASS Guarantee, you will be told to re-contact
us on 0905 511 0052.

You
are not permitted, unless you have prior written
authorisation from us on Detail Technologies Ltd
headed paper, to reproduce, copy, rent, lease, allow
third party usage, sub-licence, loan, re-sell or
extract any of our software or individual Questions
and Answers. Gold PASS users who have the ability
to print the Questions and Answers, from the program,
for use away from their machine must only use those
Questions and Answers for their sole use, these
documents cannot be passed on to, or viewed, by
any other party without prior approval from Detail
Technologies Ltd.
The
only technical requirements for PASS is that PASS
needs at least 128MB RAM on the computer that it
is to be installed on and the program requires your
machine to have a USB Port. The PASS CD-ROM will
not be able to be returned because it cannot be
used due to insufficient memory or because it does
not have a USB port fitted, if the product has been
unsealed, registered, or if the right to cancel
is not made within 7 working days of receiving the
order.
The
PASS CD-ROM is not compatible with Apple Macintosh®
machines. Apple Macintosh® users please look
at our alternative PASSONLINE
product, which is exactly the same as the PASS CD-ROM,
under our online services menu.

Dongle
If
you lose or damage the dongle supplied with your
software product you will therefore not be able
to use the product until you purchase a new dongle
from us.
The
cost of purchasing a new dongle is £20.

Online Services
We
will ensure that the online services are available
all of the time, excluding periods where scheduled
maintenance is necessary and is being carried out,
or when unforeseeable and unavoidable disruptions
to the service have occurred.

PASS
Guarantee
Our
standard Terms and Conditions are amended by the
PASS GUARANTEE terms and conditions below, if you
choose to purchase a PASS GUARANTEE with your software
product. If you do not comply to the PASS GUARANTEE
terms and conditions, as well as the terms and conditions
outlined above, this will invalidate your PASS GUARANTEE.
The
PASS GUARANTEE terms and conditions are:
(a)you
must complete and ensure we receive (either electronically
or via post) PART 1 of the PASS GUARANTEE and Questionnaire
within one month after the date of your purchase
of the PASS Guarantee
(b)you
must complete and ensure we receive (either electronically
or via post) PART 2 of the PASS GUARANTEE and Questionnaire
within 1 week of the date that you sit your examination
(c)you
must complete and ensure we receive (either electronically
or via post) PART 3 of the PASS GUARANTEE and Questionnaire
within 1 week of receipt of your national examination
results
(d)you
must ensure we receive (either electronically or
via post) a copy of your fail certificate
(e)you
must sit your next eligible exam

If
you fail to complete any of the above PASS GUARANTEE
terms and conditions (points (a) -(e)) this will
invalidate your PASS GUARANTEE.
Provided
that you adhere to all the conditions as set out
above we will continue to provide you with support
and updates free of charge until you pass the examination
that you purchased the PASS Guarantee for.
•
Please note that the free updates only apply to
any software products that you have purchased, they
do not apply to any Book or Audio products.
To
be provided with a copy of next years PASS free
of charge, under the PASS Guarantee scheme, we require
a copy of your examination failure notification
and a signed letter from you detailing your intention
to re-sit the examination at the next available
opportunity.
Due
to security issues, the only way the software can
be obtained is if we receive a hand signed document
from you, either by fax or post, no other form of
communication (such as email) is acceptable. The
form that you need to complete and send to us can
be downloaded here.

With
the PASS Guarantee you will also be entitled to
free Technical Support, via our telephone number
of 0870 800 2 999 (please note
that calls to this number are charged at local rate),
instead of having to pay 60p per minute, after the
initial 7 days, as is the case without purchasing
the PASS Guarantee.
•
A PASS Guarantee can only be purchased for a software
or online services pack, or a PASS/PASSONLINE &
MCQ Books product. The PASS Guarantee can either
be purchased initially when the product is purchased,
or at any time within 1 calendar month after the
product was originally purchased.
The
terms and conditions are exactly the same for PASS
Guarantee customers who purchase the PASS Guarantee
up to 1 calendar month after they have purchased
their software product.
•
If your PASS Guarantee is invalidated by you failing
to adhear to the terms and conditions outlined above
you will have to pay our standard upgrade prices
for any updates to your product.

If

to be invalid by any court having competent jurisdiction,

Technologies Ltd ignores this, Detail Technologies
Ltd will still be entitled to use its rights and
remedies at a later date or in any other situation
where you breach the Terms and Conditions.
Detail
Technologies Ltd shall not be responsible for any
breach of these Terms and Conditions caused by circumstances
beyond its control.
A
person who is not a party to these Terms and Conditions
shall have no right under the Contract
(Rights of Third Parties) Act 1999 to enforce
any term of these Terms and Conditions but this
shall not affect any right or remedy of a third
party which exists or is available apart from that
Act.
We
may update these Terms and Conditions from time
to time and any changes will be notified clearly
at the top of this screen.
These
Terms and Conditions shall be governed by and construed
in accordance with the laws of England and Wales
and any disputes will be decided only by the courts
in Wales.
